*As per new TREC rules, any 30 hour course and exam cannot be completed in less than 3 days (12 hours per day). Therefore it will be at least 18 days before you can complete the 6 required courses.


Please note, TREC will not accept your certificate of completion for this course unless 3 days have elapsed since the date/time you started the course. Your participation in this course must not exceed 12 hours per day. Example: If you started the course on March 2 at 11:00AM, then the soonest you could take the final exam would be March 4 at 6:00AM (3 days at 12 hours per day). Please note you are not required to work on the courses 12 hours per day, but this is the maximum amount of time per day. Starting and completing more than one qualifying course within the same 3 days does not comply with Commission rules. TREC cannot award credit for courses and certificates that are not in compliance. RELEVANCE OF THE COURSE 
  • This course introduces general contract law concepts and explores the changing field to include such topics as the Deceptive Trade Practices Act (DTPA), ownership rights and limitations, and sales contracts. 
  • This course has inclusivity when viewing the requirements under the Texas Occupations Code 1101.003. 

COURSE DESCRIPTION 
  • Texas Law of Contracts covers the use and application of basic real estate law and promulgated contracts during real estate transactions.

PURPOSE OF THE COURSE This course is designed to help students seeking a real estate license and real estate practitioners understand the forms that are used in real estate transactions. Promulgated Forms is a course of study required by The Real Estate License Act (TRELA) for all persons seeking a real estate license. This course focuses on all statutory topics and ethical standards required by TRELA for a prelicensing promulgated forms core course. As a core real estate course, it equips students with the information they need to pass their exam, get licensed, achieve success as a salesperson, and to serve their clients and customers in a way that is fair, ethical, lawful, and respectful. 

RELEVANCE OF THE COURSE This course introduces contract law and explores individually the contracts, addenda, amendment, and other forms promulgated by the Texas Real Estate Commission. This course has inclusivity when viewing the requirements under the Texas Occupations Code 1101.003. 

COURSE DESCRIPTION Texas Promulgated Forms covers selecting the correct form or forms that are appropriate to define the agreement of the parties to a real estate transaction; completing promulgated forms and addenda to accurately set forth the wishes and intents of the parties; business details covered in the contract; how and when to use an amendment or an addendum; identifying notices and their roles; the unauthorized practice of law and how to avoid it; potential legal problems; and parties’ options under the contract. The content of this course is in two books: Texas Promulgated Forms (textbook) and Texas Promulgated Forms Supplement (supplement). The supplement contains the Texas Real Estate Commission (TREC) forms discussed in the textbook. As students read through the textbook, they will look up the form in the supplement and carefully read the language in it. Thoughtful study of these forms will ensure success on the exam and in a student’s real estate practice. For ease of use, all forms are listed in the table of contents of Texas Promulgated Forms Supplement. Refer to the contents page for the location of the form. The forms are provided in the supplement according to the form’s type (promulgated contract, promulgated addenda, approved form, etc.) and in the same order they are listed in the textbook under the Use of Promulgated Forms section in Chapter 2. There are case studies/practice transactions in the textbook in Chapters 5, 6, and 9. The forms needed for those activities are in the supplement in the Case Studies section. Students will fill out the forms according to the scenario transaction in the textbook and then check them against the filled-out forms that appear immediately after the blank forms for that case study.

PURPOSE OF THE COURSE

This comprehensive course discusses the real estate finance process in an easy-to-understand format. It covers the finance industry in depth, from the big picture of the cycle of real estate finance down to the details of the various financing programs. The past several years have seen tremendous changes in the real estate financing market and this course will bring students up to date on what occurred during the economic downturn and what real estate financing looks today.

RELEVANCE OF THE COURSE

Most real estate activities are financed. Real estate professionals who attend this course and learn the process of financing will be able to offer their clients comprehensive service and will be more likely to achieve success in the business. The ups and downs in the financing market affect all aspects of real estate. TREC "3 day Rule"

TREC Requirements are:
“Please note, TREC will not accept your certificate of completion for any qualifying course unless 3 days has elapsed since the date/time learners started the course. Participation in these courses must not exceed 12 hours per day.

Starting and completing more than one qualifying course within the same 3 days does not comply with Commission rules.

Course final exams must be proctored

After completing the final exam, the certificates will not be issued and the course status will show as “Affidavit Received” until the internal verification is completed which will take 48-72 hours.

Certificates will be issued as soon as the course progress is verified.​
​TREC Guideline Update regarding PROCTORING

New guidelines now require students of this course to have their exams proctored (after August 31st) and you have the right to request a criminal history evaluation (where applicable) before enrolling in the courses or applying for a license. 

Under the new rules, you will be required to find an eligible Proctor and give the exam in his/her presence to qualify for a completion certificate. The following are acceptable third party proctors:

  • 1 Employees at official testing or learning/tutoring centers
  • 2 Librarians at a school, university, or public library
  • 3 College, university, secondary, or elementary school - Administrators, faculty, teachers, or academic advisors
  • 4 Clergy who are ordained/certified and affiliated with a specific temple, synagogue, mosque, or church
  • 5 Members of the court system – Judge, justice of the peace, magistrates, and prosecutors.
  • 6 Law Enforcement Officers – Sergeant, lieutenant, or captain
  • 7 Military installation or correctional facility educational officers

Q. Does the student give TREC (or 360) the proctor's qualifications and email address ? 
A. The student provides the proctor info to 360 which is done by filling out the online affidavit after passing the final exam.

Q. Does the proctor then get an email with a code that they enter after the exam? –
A. The proctor code step comes up before taking the final exam. This step helps the student to understand that the proctor has to be sitting with them.

Q. What does the online Proctor Affidavit look like ?

Q How does the Proctor sign off on it digitally? 
A. They sign off through DocuSign after passing the final exam in the course.

Q. Do I have a choice between Online Proctoring and In Person proctoring?
A. Yes you will have the option at checkout whether to purchase the in-person proctored version of the exam or the RPS version of the exam.

Q. What is RPS?
A. RPS is the recorded proctoring solution where the student takes the exams at their convenience and then our in-house proctors review the recording and approves (or denies) within 1 business day. The student must have access to high-speed internet and a webcam with a microphone to be eligible for the RPS proctoring.
